Family placement terms

MIA Nanny Agency Service Agreement

Effective September 23, 2026. Please review these terms before submitting a family application or making an agency payment.

All agency fees are final and non-refundable.

Replacement support is provided instead of refunds, subject to the selected package and the terms below.

  1. Clause 1

    Agreement to Terms

By submitting a family application, making any payment, signing electronically, accepting a candidate referral, or using Agency services, the Client confirms that they have read, understood and agreed to this Agreement.

  2. Clause 2

    Agency Services

MIA Nanny Agency provides referral, recruiting, screening coordination, candidate presentation, interview coordination, consultation and placement support for nannies, baby nurses, newborn care specialists, housekeepers, household managers and related household professionals.

  3. Clause 3

    Independent Referral Status

The Agency operates solely as a referral-based placement agency. The Agency is not the employer of any candidate, is not a detective agency, and does not direct, supervise, control, schedule or pay a placed candidate. The Agency does not assume the Client's payroll, tax, insurance or employment-law obligations.

  4. Clause 4

    New Family Retainer

A mandatory $500 non-refundable retainer plus applicable taxes begins the search. It is credited toward the selected placement package total. It covers administrative processing, recruiting efforts, candidate sourcing, family onboarding, scheduling coordination, placement support, profile review, staffing coordination and matching services.

  5. Clause 5

    Placement Packages and Fees

The available packages are Basic / Advise: $1,500 plus applicable taxes with a 90-day replacement warranty; Standard Package: $2,500 plus applicable taxes with a 6-month replacement warranty; Premium Package: $3,500 plus applicable taxes with a 12-month replacement warranty. Package scope and warranty eligibility remain subject to this Agreement.

  6. Clause 6

    Payment Terms

The $500 non-refundable retainer plus applicable taxes is due to activate the search and is credited toward the selected package total. The remaining package balance and applicable Florida sales tax must be received and verified before contact details are released, any in-person meeting or paid trial occurs, a candidate is released, hiring is authorized or the first working day begins. Accepted methods include Zelle, Venmo, wire or bank transfer, and other methods expressly approved by the Agency.

  7. Clause 7

    Non-Circumvention of Agency

The Client may not directly or indirectly hire, engage, refer, introduce, share, transfer or arrange work with any candidate introduced by the Agency without the Agency's written approval and full payment of all applicable fees. This restriction applies whether the engagement is temporary, permanent, part-time, full-time, trial, consulting or through another person or entity.

  8. Clause 8

    Candidate Referral Restrictions

The Client may not solicit or hire a referred candidate's friends, relatives, colleagues or contacts as a way to avoid Agency fees. Any resulting introduction or engagement must be disclosed to and approved by the Agency.

  9. Clause 9

    Non-Refundable Service Fees

ALL AGENCY FEES ARE FINAL AND NON-REFUNDABLE. This includes registration fees, placement fees, administrative fees, recruiting fees, service charges, retainers and onboarding fees. Once Agency services begin, operational and recruiting expenses are immediately incurred and no refunds shall be issued.

  10. Clause 10

    Replacement Warranty Policy

Refunds are not available. Instead, the Agency provides one replacement search at no additional placement fee during the active warranty period for the selected package: 90 days, 6 months or 12 months. Replacement support applies only while the Client remains current on all obligations and cooperates with the replacement process.

  11. Clause 11

    Warranty Period Terms

The warranty begins on the placed candidate's first official working day. A replacement request must be submitted in writing within the active warranty period. After expiration, no refund, replacement or credit is due. Unused warranty time has no cash value and does not transfer to another family, role or future search.

  12. Clause 12

    Replacement Process

Timing depends on the position, market and candidate availability. Communication may occur by email, text, phone, Zoom or FaceTime. Replacement candidates may differ in background, rate, schedule or qualifications, and the Agency does not guarantee an identical replacement or a specific completion date.

  13. Clause 13

    Candidate Screening

Screening may include identity verification, professional reference checks, interview evaluations, CPR or certificate verification, skills assessment, driving-record review and criminal-background screening. The precise checks depend on the role, information available and third-party provider coverage.

  14. Clause 14

    Background Checks and Disclosures

Background information may come from candidates, references, public records and third-party screening providers. The Agency uses reasonable care but cannot guarantee the accuracy, completeness or continuing validity of any report, disclosure, credential or statement, and cannot predict future conduct.

  15. Clause 15

    Trial Periods

Paid trials are authorized only after the remaining balance is paid in full. Trials are paid directly to the candidate by the Client at the agreed rate. A trial does not alter, waive, reduce or make refundable any Agency fee.

  16. Clause 16

    Confidentiality

Client and candidate identities, profiles, resumes, contact details, background reports, references, addresses, schedules, family information and documents are confidential. They may be used only for the intended placement and may not be copied, forwarded, published or disclosed without written permission.

  17. Clause 17

    Employment Relationship

The Client is the sole legal employer of any hired candidate and is responsible for payroll, taxes, withholding, workers' compensation, insurance, overtime, scheduling, benefits, workplace safety, supervision, immigration and employment eligibility compliance, and all other legal obligations.

  18. Clause 18

    Hold Harmless and Indemnification

To the fullest extent permitted by law, the Client releases, defends, indemnifies and holds harmless the Agency and its owners, employees and representatives from claims, damages, liabilities, injuries, losses, costs or disputes arising from a candidate's acts or omissions, the employment relationship, the Client's household, or the Client's breach of this Agreement.

  19. Clause 19

    Non-Disparagement

The parties agree not to knowingly make false, misleading or malicious statements that damage the reputation of the other party. This clause does not restrict truthful statements required by law, reports to authorities, testimony or protected legal rights.

  20. Clause 20

    Governing Law and Venue

This Agreement is governed by the laws of the State of Florida. Any dispute not resolved informally shall be brought in a court of competent jurisdiction in Palm Beach County, Florida, unless applicable law requires otherwise.

  21. Clause 21

    Entire Agreement

This Agreement, the selected package, written invoice and any signed placement documents form the entire agreement concerning Agency services and replace prior oral or written discussions on the same subject. A change is effective only when confirmed in writing by the Agency.

  22. Clause 22

    Client Acknowledgment

By submitting payment, signing electronically, submitting the family application, accepting candidate information or using Agency services, the Client acknowledges these terms, the non-refundable fee policy, the selected replacement warranty and the Client's status as the candidate's sole employer.

All agency fees are final and non-refundable; replacement support is provided instead of refunds. Florida sales tax is applied per county. Terms and conditions may apply. The Agency operates solely as a referral-based placement agency — the Agency is not the employer of any placed candidate. All candidates are hired directly by the Client, who assumes full responsibility as the legal employer. Payments accepted via Zelle, Venmo, and bank transfer.
